Good Samaritan Law and Immunity

Course Description

In 2015, Nevada’s, “Good Samaritan Drug Overdose Act” was enacted. One part of this law, NRS 453C, was intended to encourage persons to activate EMS to render aid to persons who may be overdosing. The intent; to save lives without fear of incrimination; the barrier, the immunity remains untested.

During this 60 – minute didactic course, attorney’s will evaluate the practical nuances of this defense strategy. Through wider awareness of this law, the hope is that the lifesaving intent of the law will be realized in Nevada through application and precedent.

Learning Objectives

  1. Understanding essential elements of NRS 453C and its intent.
  2. Reviewing what charges the law does and does not protect against.
  3. Review of mitigating factors in, “Overdose immunity laws”.

 

Presenter

Tiffany L. Nocon, Esq., is an Assistant Federal Public Defender for the District of Nevada*. She litigates capital and non-capital cases and chairs the Federal Public Defender’s Diversity and Inclusion Committee.

In the legal community, Ms. Nocon is an editor of the Nevada Attorneys for Criminal Justice’s (NACJ’s) monthly publication, The Round Up. She serves on the Southern Nevada Association of Women Attorneys’ (SNAWA’s) Membership Board. She is also a member of the Latina/o Bar Association.

 

Ms. Nocon clerked for the Honorable Kenly Kiya Kato in the United States District Court for the Central District of California. She also worked as a trial attorney at the Public Law Center, where she provided free legal services to low-income individuals in Orange County, California. She earned her Juris Doctor from the USC Gould School of Law and bachelor’s degree from UCLA.
